By accessing, browsing or using the Site, you (a) acknowledge that you have read, understand, and expressly agree to be legally bound by these Terms and Conditions (including our privacy policy (“Privacy Policy”)) (the “Terms”), (b) agree to follow these Terms and Conditions and all applicable laws and regulations governing our Site, (c) represent and warrant that you are at least 18 years old, are a resident of the United States, and have the right, authority, and capacity to enter into these Terms and Conditions (either on behalf of yourself or the entity you represent if you are using this Site on behalf of an entity). If you do not agree with these Terms, you are not authorized to use or access this Site.
Bedroomchemist.com reserves the right to revise these Terms at any time and without prior notice by updating this posting. You are encouraged to review these Terms each time you use the Site because your use of the Site after the posting of changes will constitute your acceptance of the changes. If updates are made to these Terms, we will note when these Terms were most recently updated at the bottom of the Terms.

1. USE OF THE SITE

Subject to the terms and conditions of this Agreement, Bedroomchemist.com hereby grants you a personal, limited, revocable, non-transferable and non-exclusive license to access and use the Site by displaying it on your internet browser only for the purpose of shopping for a membership, subscription or items sold or offered on the Site and not for any commercial use or use on behalf of any third party. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
Bedroomchemist.com reserves the right, in our sole discretion and without notice to you, to revise the products and services available on the Site and to change, suspend, or discontinue any and all aspect of the Site. Bedroomchemist.com will not be liable to you or any third party for doing so.
Your access to this website may be partially or entirely suspended or terminated at any time without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes.
We control and operate the Site from the United States. We make no representation that materials on the Site are appropriate or available for use outside the United States. If you choose to access this Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

2. PRIVACY POLICY

Bedroomchemist.com respects your concerns about protecting your privacy. Please review a copy of our Privacy Policy on this Site which describes the types of information we gather about our customers, how we use the information, with whom we share the information, and how we protect the information. You agree that your use of this Site signifies your assent to this Privacy Policy. If you do not agree with this Privacy Policy, you are not authorized to use this Site.
Bedroomchemist.com reserves the right to update and change our Privacy Policy periodically and without prior notice. If updates are made to our Privacy Policy for the Site, we will post the revised Privacy Policy and update at the bottom of the notice when the Privacy Policy was most recently updated. We encourage you to review this Privacy Policy frequently.

3. MEMBERSHIPS AND SUBSCRIPTIONS

In order to purchase products or subscriptions from the Site, you must register and become a member. We will collect information from you including but not limited to your name, address, credit card number and expiration dates. You must provide and keep us up to date with accurate member information. You agree that we may update your information with information your bank or credit card issuer may supply, or other information available to us. All personal information is subject to Bedroomchemist.com’s Privacy Policy, incorporated into this Agreement.
The Site, its products or services are only available to those who are 18 years and older and who have not been suspended or removed by Bedroomchemist.com for any reason. IF YOU ARE UNDER 18 YEARS OF AGE, YOU MAY NOT USE THE SITE, ITS PRODUCTS OR SERVICES. We reserve the right to revoke your membership for any reason at any time including as a result of a violation of these Terms of the Privacy Policy, without notice. Membership is void where prohibited by law.
By registering and becoming a member, you may be issued a user name and / or password. You agree to accept responsibility for all activities and financial liability that occur under your membership account and password whether or not it is authorized by you, including without limitation, all communications and transmissions and all obligations (including without limitation financial obligations) incurred through such access or use. You will be solely responsible for maintaining the confidentiality of your account and password, and for restricting access to your account. You shall notify Bedroomchemist.com immediately of any unauthorized use or your password or identification or any other breach or threatened breach of this Site’s security.
Bedroomchemist.com currently has two subscription options:
1. Pay-As-You-Go. Upon establishing this subscription, you’ll be billed $49.99 plus sales tax if your shipping address is in New Jersey. After you receive your first kit, the subscription will automatically renew and you will be billed the entire amount again unless you decide you would like to cancel your subscription. If you would like to cancel your subscription before your next billing, you must log into your account at https://bedroomchemist.com/login.php and click the “Cancel Subscription” button BEFORE your next billing date. Your next billing date can be found on your account profile. If you cancel after your next billing date, we will not charge you for any subsequent Kits, but you will receive a final Kit if you already paid for that Kit.
2. Boudoir Bliss™. Upon establishing this subscription, you’ll be billed $199.99 plus sales tax if your shipping address is in NJ. The “Boudoir Bliss” subscription requires full payment to commence. YOU WILL NOT BE REFUNDED FOR ANY PORTION OF YOUR BOUDOIR BLISS SUBSCRIPTION THAT HAS NOT BEEN FULFILLED. After you receive 4 kits (and any applicable gifts), your “Boudoir Bliss” subscription will automatically convert to the “Pay-As-You-Go” subscription unless you decide you would like to cancel your subscription. If you would like to cancel your “Pay-As-You-Go” subscription, you must log into your account at https://bedroomchemist.com/login.php and click the “Cancel Subscription” button BEFORE your next billing date. Your next billing date can be found on your account profile. If you cancel after your next billing date, we will not charge you for any subsequent Kits, but you will receive a final Kit if you already paid for that Kit.

In addition, the Site may sell individual featured products. Membership is required to purchase individual featured products. However, you do not need a subscription to purchase individual featured products.

You may use the Site only for your own noncommercial personal use and in compliance with these Terms. You are responsible for your own communications, including the transmission, uploading or posting of information and are responsible for the consequences of such communications to the Site. By using the site, you agree not to use the site to post, communicate or transmit: (1) Any material that infringes on any intellectual property, publicity or privacy right of another person or entity and (2) Any information which is untrue, inaccurate or not your own. You agree not to engage in conduct that would constitute a criminal offense or give rise to civil liability or otherwise violate any law or regulation. You agree not to attempt to interfere in any way with the Site’s network security, or attempting to use the Site’s service to gain unauthorized access to any other computer system.

Bedroomchemist.com may terminate your membership and refuse any and all current or future use of the Site or other services (1) in order to comply with applicable law (2) if you provide any information that Bedroomchemist.com determines, in its sole discretion, to be untrue, inaccurate, not current or incomplete (or if the information becomes untrue, inaccurate, not current or incomplete), (3) if Bedroomchemist.com determines, in its sole discretion, that you are using your membership in a manner not permitted by the terms of Service, or (4) in other circumstances, as Bedroomchemist.com deems appropriate in its sole discretion. BEDROOMCHEMIST.COM RESERVES THE SOLE RIGHT TO DECIDE IF ANY OF THE UNUSED PORTION OF YOUR SUBSCRIPTION WILL BE REFUNDED TO YOU.
Bedroomchemist.com is not responsible for any fees or charges that your bank or credit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method including a mailed statement.

4. PURCHASES & RETURNS

Purchasing a product or subscription from the Site represents an offer to purchase goods as indicated by you, but is not binding on us until you have been notified by email that an order is accepted. This means that if goods shown on this website are unavailable, incorrectly priced or otherwise incorrectly described, the Site shall not be obliged to sell you those goods. Bedroomchemist.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price whether or not such orders have been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Bedroomchemist.com shall immediately issue a credit to your credit card account in the amount of the charge.
We also reserve the right to limit quantities purchased by Members and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted and/or acknowledged). We do not guarantee that all products described on our Site will be available.

Given the intimate nature of the products sold on the Site, returns are not permitted. If a product you receive is defective, please send us an email to feedback@bedroomchemist.com. We will provide you with return instructions and replace it with a like item. Exact replacements are not guaranteed.

5. PAYMENTS & DISCOUNTS

By purchasing a product or subscription from Bedroomchemist.com, you authorize 65 VENTURES LLC to charge you the full product amount or subscription term plus shipping, handling and taxes for the products, at the posted prices, beginning immediately upon enrollment. Bedroomchemist.com products will only be shipped after payment has been processed. After the terms of your subscription are fulfilled, your subscription will automatically renew and you will be billed the full subscription amount for a “Pay-As-You-Go” Subscription again unless you decide you would like to cancel your subscription, or unless terminated by us in accordance with this Agreement.

You represent and warrant that: (1) any credit card or other payment information you supply is true and complete, (2) charges incurred by you will be honored by your credit card company, and (3) you will pay the charges incurred by you at the posted prices, including any applicable taxes or shipping and handling fees. In the event we have to collect unpaid amounts you owe us, you will be liable for all attorneys’ and collection agency fees.

For your convenience, when you place your first order and become an official member, we will save your credit or debit card information and use it for all future shipments and charges which will automatically be charged to your saved card, unless you notify us online or through email. For your convenience and continuous membership benefits as a client, if your payment method reaches its expiration date and you do not edit your credit card information or cancel your account, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to constantly update your payment method information or cancel your account should you wish to discontinue your membership with us.

If you are provided with a discount or promotional code (called a “Chemist Code), the discount can only be applied to your initial order at the time of purchase only. Any subsequent Kits will be charged at the original non-discounted price. Promotional codes cannot be combined.

6. SHIPMENTS

Bedroomchemist.com is not responsible for incorrectly entered shipping information such as shipping addresses or changes of address. Please be sure that you are entering the correct address at checkout and to include applicable apartment or suite numbers. Please update your profile immediately or notify us immediately via email at orders@bedroomchemist.com if you have a change in address.

RISK OF LOSS: Any merchandise purchased from our Site will be shipped by a third party carrier. As a result, title and risk of loss for such merchandise will pass to you upon our delivery to the carrier.
We shall be under no liability for any delay or failure to deliver products or otherwise meet any obligation put forth here if the delay or failure is in full or in part caused by circumstances beyond Bedroomchemist.com’s reasonable control.
We do not ship to addresses outside of the United States.

You acknowledge and agree that the content (other than content that may be submitted by Members), materials, text, images, videos, graphics, trademarks, logos, button icons, music, software and other elements available on the Site are the property of Bedroomchemist.com or our licensors and are protected by copyright, trademark and/or other proprietary rights and laws. You agree not to sell, license, rent, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, modify or create derivative works from any content or materials on the Site.

Bedroomchemist.com and 65 VENTURES LLC shall in no event be liable for any direct, indirect, punitive or incidental damages arising out of or in connection with the use, inability to use, USER’S RELIANCE, or performance of the information, products or services on this website or a linked site.
